I do my best to customize your session to your personal needs. 
From session to delivery, I spend between hours working with you and your photos to ensure that the selected portraits are to your liking. Please keep this in mind when booking your sessions, and give yourself plenty of breathing room for any deadlines involving your images. 

Mini Session turnaround is 10-14 days unless otherwise quoted. Standard Portrait turnaround for Full Sessions is generally 2-3 weeks, and Special Event turnaround will be quoted on a case by case basis. Images will be uploaded to a password protected online gallery where you can view and share watermarked images, and use your coupon code to download your favorite images. You may also order additional digitals or prints if you choose. Ordering prints through my pro lab is recommended, but you may choose to use your high resolution digital files and print release as you wish. A preview image is usually shared through our Facebook page within 72 of the shoot when possible.

I am excited to photograph you and those you love! Don't forget to dress for the shoot! If you are stumped on what to wear, I am more than happy to help you brainstorm, or you can find an endless supply of articles or suggestions online or by searching Pinterest (feel free to share the link to your board if you have a specific vision!)

In case of rain or inclement weather when outdoor shoots are planned all attempts will be made to arrange a rain date that is best for the majority of attendees. If you are unable to attend that date, your deposit or session fee can be used toward another session, product or service. If you cannot make your session please notify us as soon as possible. Refunds or credit towards a new session are at the discretion of the photographer.

PHOTO SHOOT CONSENT

Note: This is a legal binding agreement; please do not sign or complete payment if you do not understand this document.
Right to Use: By making a payment or purchasing a session, you and other members of your party are agreeing to grant Kerry Colombo (DBA Olive Juice Productions) the right to photograph you, your dependents and your property (if applicable). Kerry Colombo retains the copyright, use and publish in print and/or electronically. I understand my images may be used for advertising or web content purposes. You also acknowledge you have shared this information with all parents of all minors present, and they agree to these terms.

I agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited and subjective nature of the event, the Photographer cannot be held responsible for requested photographs not taken or missed due to lack of cooperation by subjects or by other unforeseen events. Please be realistic when choosing the length of your session and plan for the longer session if you are unsure. Warming up to kiddos takes a bit of time, especially if there is more than one child to be photographed and changing clothes, or setups can take up valuable shooting time.

If the Photographer or assistant cannot perform this agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the Photographer shall return any monies paid by the Client, less retainer fee (initial payment) and expenses, but shall have no further liability with respect to the Agreement. 

The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. Please make all checks payable to Kerry Colombo. Returned checks or chargebacks from your credit card company or Paypal are subject to a $50.00 returned check fee. Client assumes responsibility for any and all collection costs and legal fees incurred by the Photographer in the event that enforcement of this contract becomes necessary. All legal action shall be taken appropriately. 
This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer. 

Exclusivity - In order for the client to receive the best images possible, Absolutely NO CELL PHONE PHOTOS during the shoot are permitted. (Including photos of subjects being photographed, setups or photographer(s).

Your date is not guaranteed unless a deposit has been received. Final Payment is due on the date of the session. A 10% penalty is assessed if the final payment is more than 24 hours past the session date, and an additional $10 per week thereafter.

Liability Waiver - I waive Kerry Colombo of all liability of associated with this photo shoot. This includes the highly unlikely events of bodily harm, damage, theft or injury resulting from events that may occur. Every effort is made to keep safety the top priority. Photographer is not responsible for uncooperative parties. 

If there are any special needs or requirements, or any information I should know prior to the shoot, please reach out! I do my best to accommodate almost any request! Feel free to send any inspiration boards, or prop/setup ideas ahead of time, also if there is a specific "good side" you prefer, or if there is anything anyone I will be photographing is self conscious of, or anything you'd like to minimize I would love to know ahead of time. I am happy to send pose or wardrobe inspiration photos if requested! 

I do basic touchups to the photos from each shoot in Adobe Photoshop and or Adobe Lightroom, and 30 minutes of additional editing requests you may have per mini session, and 2 hours per full session to of additional edits to the images you want to purchase (or use your credit toward) but more involved editing can be requested at an hourly rate. Please send me a message or email to discuss any specifics. Please be mindful of this before your shoot when choosing a wardrobe that is flattering, and when preparing for your shoot. If you plan for a haircut, the photo shoot usually looks best a few days after the cut. Makeup is best on the lighter side, and when applied in natural light. Although they can be retouched if necessary, blemishes or bruises are usually easiest to cover with concealer before the shoot rather than using your editing time afterwards (although I am happy to do so if necessary)! Clear eyes or visine works wonders for adults before a shoot for vibrant whites.

Photographer is not responsible for any accidents or injuries inflicted upon any participating parties. Client(s) will be responsible for themselves and guest if applicable (please give advance notice if you'd like a friend to attend with you to assist) and release photographer from any claims against their person or their business and will not disparage the photographer or business publicly or privately and will not attempt to contact existing or past clients or any behavior that inhibits the photographers ability to proceed with the session. Any issues should be brought to the photographers attention immediately. 

Reshoots will not be given for poor choices of clothing, make-up, hair, etc., or by not following the recommendations of Photographer. This session is all about you and we cannot wait to capture beautiful images for you! Please let us know ahead of time if there is anything we can do to make you more comfortable. We rely on cooperation from you and clear communication prior to our session date so we can do our best work for you.

Photographer will not be liable in the unlikely event that a problem arises, whether due to accident, loss of materials, acts of God, equipment or other failures not caused by Photographer. Photographer is not responsible for loss of, or interference with, the photography or Images including but not limited to, restrictions of the location, interference from surrounding devices, access limitations, flash restrictions, equipment malfunctions and other similar the like. This limitation on liability shall also apply in the event that photographic materials or images are damaged, lost through camera malfunction, lost in the mail other otherwise lost or damaged without fault on the part of Photographer. 

Client agrees to indemnify and hold harmless Photographer against any claims, lawsuits, judgments, court costs, damages and other expenses, including attorneys’ fees, arising from or related to Client’s use of the Images or Photographer’s performance of this Agreement. Client also certifies they are 21 years of age or older. 

Olive Juice Productions retains all copyrights to all images created during client’s session. A print release for the amount of agreed upon images and package inclusions is outlined in the invoice. Hand editing will be done at photographers discretion. Please advise photographer prior to the session if you are self conscious of any specific areas or if you'd like to accentuate. Please brainstorm and discuss any pose requests or setups prior to session when possible to maximize shooting time. Keep in mind desired poses when booking your time slot, though photographer may help advise what a reasonable time is for a certain pose or session, we are not responsible for concepts or outfits that are not able to be photographed due to time constraints.

Print release does not allow publication of your portraits (i.e. entering in contests), commercial use, selling or altering (editing in any manner, including cropping) of your images without Photographer’s written permission. It is a violation of the Federal Copyright Law and illegal to copy, scan, download, print, share, alter, or otherwise steal any image created without said print release. This applies to images posted in an online proofing gallery, Facebook, Blog, Instagram, Twitter or hard copy images or screen shots. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at $100 per image. Client may use watermarked images provided by photographer per client's request and is encouraged to do tag and share any post.

Also, please plan ahead for your shoot, if you think you might need extra diapers, wipes, bottles, hair pins, a pair of shoes for walking from location to location if wearing heels, Also a snack or beverage might be helpful to have on hand for kiddos if the shoot is scheduled during their normal snack or mealtime. Parents often bring a special prize or incentive for little ones to cooperate if necessary. 

Thank you for allowing me to capture a special time in your life! I have never met someone who regrets having "too many photos" of their family!
